What To Do If You Are Arrested in Florida
1. Stay Calm and Remain Silent
Do not argue with the police or resist arrest. Stay calm and respectfully invoke your right to remain silent. Remember: "Anything you say can (and will) be used against you."
2. Ask for a Lawyer Immediately
You have the right to an attorney. Clearly state, “I want a lawyer,” and do not answer any questions until your lawyer is present. Do not try to explain, justify, or talk your way out of the situation.
3. Do Not Consent to Searches
Unless the police have a warrant, you are not required to consent to a search of your person, vehicle, or home. Politely say, “I do not consent to a search.”
4. Don’t Discuss Your Case with Anyone but Your Attorney
Be careful of phone calls, texts, or conversations with friends, family, or cellmates. Prosecutors can (and will try to) use anything you say against you later (especially recorded jail calls, text messages, emails, voicemails, etc...).
5. Know Your Rights During Questioning
If you are questioned or interrogated, you have 1) the right to remain silent; and 2) the right to an attorney. Exercise both! Even casual statements can be twisted and used against you.
6. Write Down Key Details
As soon as you are able, write down everything you remember about the arrest: what was said, who was there, and what happened. This may help your defense later.
7. Follow Bond and Release Conditions
If you are released on bond, carefully follow all of the conditions set by the court. Violating any of them could hurt your case or land you back in jail.
