Criminal defense attorney and Past-President of The Florida Bar Michelle Suskauer spoke with Action News Jax following the arrest of a St. Johns County woman accused of child abuse after a viral Ring camera video showed her striking her six-year-old son during an Instacart delivery.

According to investigators, 36-year-old Kiah Lowery was arrested after video captured her hitting and yelling at her son when he dropped a 26-pound case of water. Authorities say the child weighed just under 50 pounds at the time of the incident.

Suskauer explained that the case will likely proceed on two separate tracks: a criminal prosecution and a child welfare investigation.

“This case will go in two different directions,” Suskauer said. “But both things can happen at the same time. A criminal case, as well as the Department of Children and Families investigation.”

She noted that while the State Attorney’s Office will determine whether to pursue criminal charges, the Department of Children and Families will conduct its own independent investigation into the child’s welfare.
