Criminal defense attorney and Past-President of The Florida Bar Michelle Suskauer spoke with Action News Jax and 104.5 WOKV following the arrest of the principal of Baldwin Middle-Senior High School in connection with allegations that he failed to properly report suspected misconduct involving a teacher and a student.
According to investigators, the principal was made aware of concerns raised by multiple students regarding the teacher’s relationship with a student but allegedly did not follow Florida’s mandatory reporting requirements. The arrest warrant outlines several instances in which students reported their concerns, as well as allegations that the principal attempted to address the matter internally before authorities were notified.
Suskauer explained that Florida law places clear legal obligations on school administrators and other designated professionals when they become aware of suspected abuse or misconduct involving a child.
“Whether or not the principal thinks that they’re handling it, whether or not they think that it’s credible or not, it doesn’t matter,” Suskauer said. “They’re a mandatory reporter, and they must follow the statute.”
Suskauer noted that mandatory reporting laws exist to ensure allegations are promptly reported to the appropriate authorities, allowing trained investigators to determine what occurred rather than leaving those decisions to individual school officials.
